We are committed to protecting and respecting your privacy; therefore, we encourage all our users/clients /freelancers/talents/visitors to read this policy very carefully because its contains important information which is mentioned hereinbelow.
We do collect your personal information and process your personal data in accordance with the Information Technology Act, 2000 as amended up-to-date and its allied Rules & Regulations applicable to us w.r.t Indian Users, California Consumers Privacy Act (“CCPA”), General Data Protection Regulations (“GDPR”) and other US Federal and State laws relating to data protection and privacy.
We collect your personal information/data in order to provide and continually improve our services.
Our privacy policy is subject to change at any time and the same will be accordingly notified to the users/clients /freelancers/talents/visitors through email if opted for and through updating on our privacy policy page which can be accessed through the following hyperlink https://talenteso.com/privacy/. To make sure you are aware of any changes, please also review this policy periodically.
All partner firms and any third-party working with or for Us, and who have access to personal information, will be expected to read and comply with this policy.

Scope

This Privacy Policy sets out how Talenteso collects, retains, and uses information, including personal data (“Personal Data”), about users/clients/freelancers/talents/visitors, and individuals, including our partners. This Privacy Policy also covers data that Talenteso collects in-person, for instance at interview, screening and other official interactions. Your rights in relation to your personal information and how to contact us and supervisory authorities in the event that you have any grievance with respect to your personal data.

How We Collect the Information

From you directly and through this Site: We may collect information through the Website when you visit. The data we collect depends on the context of your interactions with our website.
Through business interaction: We may collect information through business interaction with you or your representative or team.
Personal information obtained by use of cookies or other automated means. We will sometimes obtain information via automated technology. This shall be by use of cookies and other similar technology. A cookie is a small text file which is placed onto your computer or electronic device when you access our website. We collect information primarily to provide better services to all of our customers.
When you apply as a freelancer/talent/job applicant on the site, you are asking to be admitted to our Network. In order to admit you to the Network and match your qualifications with our Client’s needs, we need to perform a screening process, which evaluates your language skills, personality, domain-specific knowledge, competence and professionalism. We may also need to screen potential freelancers/talents for specific technical skills, as required by our clients. In this context, you will be asked to provide information about yourself, which includes: your name, contact information, address, location, work experience, education, photograph, Govt. issued Identity Proof, social network information, family information, billing information/financial details such as bank account etc. for the purpose of making payment to you.
For Feelancers/Talents: If and when we undertake background checks about you, we may collect additional information about you including information about criminal convictions or offences committed by you, if any. Details about any pending criminal proceedings or proceedings related to violation of any data privacy laws. If applicable, to you your consent to the collection of such additional data will be solicited at such time, pursuant to applicable laws.
Once the freelancer/talent is admitted to our network and matched with a client, we will receive from our client information regarding the performance of your services to that client, as necessary for maintaining our standards of services and integrity.
We collect personal data from our prospective Clients when we receive a request for hiring our Freelancers/Talents. This includes names and contact information of prospective Clients, their representative and such other information relating to the Client’s needs.
We may supplement the information that we collected from our Clients (such as your email address) with additional information about our Clients and their company obtained from publicly available and third-party databases or services that provide information about business people and companies (including an individual’s name, job title, business contact information, and company information).
When you visit our Site, some information is automatically collected. This may include information such as the Operating Systems (OS) running on your device, Internet Protocol (IP) address, access times, browser type, and language, and the website you visited before our Site. We also collect information about how you use Our products or services.
We automatically collect services availed or content use history, which we sometimes aggregate with similar information from other users to create features such as Best Platform for hiring freelancers, Top Rated, etc.
The full Uniform Resource Locators (URL) clickstream to, through and from our website (including date and time); cookie number; products and/or content you viewed or searched for; page response times; download errors; length of visits to certain pages; page interaction information (such as scrolling, clicks, and mouse-overs).

How we use information

We use the information we collect primarily to provide, maintain, protect, and improve our current services, complete your transactions, address your inquiries, process your registration, verify the information you provide is valid, and for compliance and internal business purposes.

Aggielands Software Inc. who controls and manages the Website/Site i.e., www.talenteso.com, is based in the United States. When you apply as a Freelancer or use our services as a Client, or otherwise use our Site, your Personal Data will be transmitted to servers in the United States as necessary to provide you with the services that you requested, administer our contract with you or to respond to your requests as described in this Privacy Policy, and the data may be transmitted to our service providers supporting our business operations (described above).
We share your data with your consent or to complete any transaction or provide any service you have requested or authorized. We also share data with our affiliates and subsidiaries working on our behalf.
We may employ other companies and individuals to perform functions on our behalf. The functions include fulfilling orders for services, sending postal mail and e-mail, removing repetitive information from customer lists, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring credit risk, and providing customer service.
These third-party service providers have access to personal information needed to perform their functions but may not use it for other purposes. Further, they must process the personal information in accordance with this Privacy Policy and as permitted by applicable data protection laws.

With third parties who work on our behalf provided such third parties adhere to the data protection principles set out in the IT Act, 2000 (21 of 2000) as amended up-to-date and its allied Rules & Regulations applicable to us w.r.t Indian Users, California Consumers Privacy Act (“CCPA”), General Data Protection Regulations (“GDPR”) and other US Federal and State laws relating to data protection and privacy, and other applicable legislation, or enter into a written agreement with Us requiring that the third party provide at least the same level of privacy protection as is required by such principles;
To comply with laws or to respond to lawful requests and legal process;
To protect the rights and property of Us, our agents, customers, and others including to enforce our agreements, policies, and terms of use;
In an emergency, including to protect the personal safety of any person;

The Ministry of Electronics and Information Technology (MeitY) is empowered to provide guidance on matters in the realm of electronics and information technology. In matters that involve security incidents, MeitY has constituted the Indian Computer Emergency Response Team (‘CERT’) which acts as the nodal agency that receives and responds to all breach notifications.
That according to SPDI Rules you have an option to opt out of providing the data or information that is being sought by us, as well as an option to withdraw consent that may have been given earlier. You may avail this option by contacting us on the details given hereinbelow.
In addition to the right to opt out of sharing information, you have the right to review the information you have provided and to seek the correction or amendment of such information if incorrect.
We have appointed a grievance officer who is to redress the grievances that you may have (Rule 5(9) of the SPDI Rules). Any grievances that you may have with respect to the processing of information will be addressed by us in a time-bound manner, and no later than a month from the date of the receipt of the grievance. The details of the grievance officer is provided below in “Contact Us”.
You can ask us to erase or delete all or some of your personal data (e.g., if it is no longer necessary to provide Services to you).
You can edit some of your personal data through your account. You can also ask us to change, update or fix your data in certain cases, particularly if it’s inaccurate.
You can ask us to stop using all or some of your personal data (e.g., if we have no legal right to keep using it) or to limit our use of it (e.g., if your personal data is inaccurate or unlawfully held).

If you ask us, we will confirm whether we are processing your Personal Data and, if so, provide you with a copy of that Personal Data along with certain other details. If you require additional copies, we may need to charge a reasonable fee.

If we shared your Personal Data with others, we will tell them about the correction where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so you can contact them directly.
You may ask us to delete or remove your Personal Data, such as where you withdraw your consent. If we shared your data with others, we will tell them about the erasure where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data with so you can contact them directly.
You may ask us to restrict or ‘block’ the processing of your Personal Data in certain circumstances, such as where you contest the accuracy of the data or object to us processing it. We will tell you before we lift any restriction on processing. If we shared your Personal Data with others, we will tell them about the restriction where possible. You have the right to be free from decisions based solely on automated processing of your Personal Data, including profiling, which produce a significant legal effect on you, unless such profiling is necessary for entering into, or the performance of, a contract between you and us, or with your explicit consent. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.

For California Residents/Individuals

California law requires us to disclose information regarding the categories of personal information that we have collected about California consumers (as that term is defined in the California Consumer Privacy Act (“CCPA”), the categories of sources from which the information was collected, the business or commercial purposes (as those terms are defined by applicable law) for which the information was collected, and the categories of parties with whom we share personal information.
The CCPA sets forth certain obligations for businesses that “sell” personal information. Based on the definition of “sell” under the CCPA and under current regulatory guidance, we do not believe we engage in such activity and have not engaged in such activity in the past twelve months.
